Terms of Service

These Terms govern your use of viralclips.pro, the ViralClips desktop application, and related services (together, the “Service”). By creating an account, buying a licence, downloading the app, or using the Service, you agree to them. If you do not agree, do not use the Service.
1. Who may use ViralClips
You must be legally able to enter into this agreement. If you use ViralClips for a business or another organisation, you confirm that you have authority to bind it to these Terms. You are responsible for keeping your account and device secure and for activity carried out through them.
2. What the Service does
ViralClips is a macOS desktop tool for turning supported local files or accessible online videos into vertical clips, generating captions, drafting optional publishing metadata, and uploading a finished clip to a connected YouTube channel.
Version 1.2.0 supports Apple Silicon Macs running macOS 14 or later. Compatibility, third-party availability, output quality, processing time, and download availability vary by source, device, network, permissions, and external service rules. We do not guarantee views, engagement, revenue, “virality,” or any other publishing result.
3. Desktop licence and updates
A completed one-time desktop purchase gives you a limited, non-exclusive, non-transferable licence to install and use the released ViralClips desktop app on compatible Macs that you own or control. You may use your exports for personal or commercial work, subject to the rights in the source material and the rules of any publishing platform.
The licence does not transfer ownership of ViralClips or permit you to resell, sublicense, distribute, reverse engineer, bypass licence checks, or use the app to build a competing product, except where applicable law expressly allows an activity that these Terms cannot restrict. “Lifetime” or “future” updates means updates we make generally available for this desktop product while it remains offered; it is not a promise that every feature, integration, operating system, or support channel will remain available indefinitely.
4. Your content and permissions
You keep ownership of content you provide and exports you create. You are solely responsible for confirming that you have all rights, licences, consents, and permissions needed to download, edit, caption, repurpose, and publish it—including copyright, music, publicity, privacy, and trademark rights.
A public URL does not by itself grant permission to download or republish a video. You must comply with the source platform’s terms, technical restrictions, and applicable law. Do not use ViralClips to infringe rights, evade access controls, upload unlawful or harmful material, impersonate others, or interfere with the Service.
5. Local processing and optional integrations
The desktop clipping, transcription, captioning, and rendering workflow runs on your Mac. Project files and exports are stored on your device. When you choose an optional integration, relevant data is sent directly from the app to that provider:
- AI metadata generation sends the selected clip transcript and instructions to OpenAI using the API key you provide.
- YouTube publishing sends the finished clip, title, description, tags, visibility, and audience choice to Google/YouTube using the OAuth client and channel you connect.
- Online source retrieval makes requests from your device to the source host and may be limited or blocked by that host.
API keys and OAuth tokens entered in the desktop app are encrypted using macOS secure storage. You are responsible for your provider accounts, credentials, quota, charges, configuration, and compliance with provider terms. You can remove a configured key or disconnect YouTube in the app.
6. YouTube publishing
YouTube publishing is an action you initiate. Before upload, you can review and edit the title and description, choose public, private, or unlisted visibility, and state whether the video is made for children. The connected YouTube channel and its owner remain responsible for every upload.
By uploading, you certify that the video complies with the YouTube Terms of Service and Community Guidelines, and that it does not violate anyone’s copyright or privacy rights. Google may restrict uploads made with an unverified API project, and YouTube availability, review, processing, and enforcement are outside our control.
7. Accounts, payments, and refunds
You may need a ViralClips account to buy, verify entitlement, or download a release. Stripe processes payments; we do not receive your full card number. Prices, taxes, device requirements, and the included product are shown before checkout.
If a payment fails, is reversed, or is refunded, the related licence or download entitlement may be suspended. Any mandatory cancellation, repair, replacement, or refund rights under applicable consumer law continue to apply. For purchase problems, contact us with the email used at checkout.
8. Website data and privacy
The website uses service providers for hosting, authentication, payments, and product analytics. We may process account details, purchase and entitlement records, support messages, basic device or browser information, and usage events needed to operate, secure, understand, and improve the Service. Those providers process data under their own terms and privacy notices.
We do not sell your source videos, desktop project files, API keys, or OAuth tokens. The desktop app keeps those project files and credentials on your Mac, except for data you deliberately send to OpenAI, Google/YouTube, or another source provider as described above. You can request help with account information by contacting us.
9. Third-party services
ViralClips can interact with services we do not control, including source websites, OpenAI, Google, YouTube, Stripe, Supabase, and hosting or analytics providers. Their terms, privacy practices, limits, prices, and availability apply separately and can change without notice. ViralClips is not endorsed by or affiliated with YouTube, Google, OpenAI, TikTok, or Instagram unless expressly stated.
10. Availability and changes
We may fix, update, replace, restrict, or discontinue parts of the Service, including features that depend on changing operating systems or third-party APIs. We aim to keep purchased releases usable on their stated supported systems, but cannot promise uninterrupted or error-free operation. Back up source files and exports that matter to you.
11. Disclaimers and liability
To the maximum extent permitted by law, the Service is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability. Nothing in these Terms excludes warranties or liability that applicable law does not allow us to exclude.
To the maximum extent permitted by law, ViralClips will not be liable for indirect, incidental, special, consequential, or punitive loss, or for lost profits, revenue, data, goodwill, opportunities, or platform access arising from the Service. Our total liability arising from the Service will not exceed the amount you paid ViralClips for the product giving rise to the claim during the 12 months before the event. This limit does not apply where the law prohibits it.
12. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate access where reasonably necessary to address fraud, security risk, legal obligations, non-payment, infringement, or a material breach of these Terms. Provisions that by their nature should survive—including ownership, payment obligations, disclaimers, and liability limits—will survive termination.
13. Changes to these Terms
We may update these Terms to reflect product, legal, or operational changes. We will revise the date above and, for material changes affecting registered users, use a reasonable method to provide notice. Continuing to use the Service after updated Terms take effect means you accept them.
